Neither an H-2A employer or an H-2A worker is required to pay Social Security and Medicare taxes on H-2A wages. However, workers may owe US federal income tax when they file income tax returns for the year. Because of this, some workers would prefer an employer to withhold from the workers paycheck. In order to do this, both the worker and employer must agree to withhold federal income tax. The worker must complete and return Form W-4 Employee’s Withholding Allowance Certificate, to the employer. Note that some states allow employers to withhold the employee’s portion of workers compensation. Review the workers compensation laws for your state.
Employers who participate in the H-2A program are required to provide free housing to all workers who are not reasonably able to return to their homes at the end of the day. The employer provided housing must meet all of the Department of Labor Occupational Safety and Health Administration (OSHA) standards.
Hemp growers can participate in both the H-2A and H-2B visa programs. The H-2A visa program is for agricultural jobs, which includes post-harvest and processing jobs. The H-2B visa program is for non-agricultural duties within the industry.
When possible, the paperwork for H-2 visas (both H-2A and H-2B) should begin 4 to 6 months before they need their workers to arrive.
Yes! The H-2A visa program is a great solution for hemp growers that have difficulty finding reliable and affordable agricultural workers. The 2018 Farm Bill made industrial Hemp federally legal and therefore these growers are eligible to use the H-2A guest worker program. Because marijuana is not yet legal on a Federal level, they are not able to use the H-2A program…. YET.
